Public offer.

Read the text of this Public Offer (agreement) on the provision of services and, if you do not agree with any of the clauses of this Public Offer (agreement), or you do not understand any of the clauses of this Public Offer (agreement), we suggest that you apply for additional explanations to the Hotel employees at the reception.

Services are provided by Park – hotel AQUADAR (Park – hotel AQUADAR), further – Hotel, which is located at the address: str. Lisova, building 1, village. Mankivka, Uman district, Cherkasy region, and include accommodation of individuals by providing a number (place) for temporary residence.

In case of acceptance of the Services offered by you in the Hotel, it is considered that you fully and unconditionally agree to all the terms of the Public Offer (agreement) on the provision of services and the rules of accommodation in the hotel set out below, in full and unconditionally accept them (including agreeing to fulfill all obligations imposed on you by the Public Offer (agreement) on the provision of services and the rules of accommodation in the Hotel) and you understand all their requirements. The public offer (agreement) on the provision of services and the rules of accommodation in the Hotel determines the content of the rights, duties, and responsibilities of the Hotel and the User, acting simultaneously and complementing each other.


1. General regulations.

1.1. This Public Offer defines the terms of the contract by Art. 641 of the Civil Code of Ukraine and is an official Public offer addressed to other persons (hereinafter – “User”/”Users” or “Guest”/”Guests”) to conclude an agreement on providing the User with accommodation services (providing a number (place) for temporary accommodation) under the conditions set out below.
1.2. In the future, according to the text of the Public Offer (agreement), the Hotel and the User are collectively referred to as “Parties”, and each individually as a “Party”.
1.3. Each Party guarantees to the other Party that it has the necessary legal capacity, as well as all the rights and powers necessary and sufficient for the conclusion and execution of the Agreement by its terms.
1.4. The text of the Public Offer (agreement), posted on the aquadar.com website. (Hotel website).
1.5. The User consents to the notification to third parties of information that arises in connection with the execution of this Public Offer (agreement) and the User’s receipt of services from the Hotel.
1.6. The Hotel’s activities are regulated by the Law of Ukraine “On Tourism”, the Rules for using hotels and similar means of accommodation and providing hotel services, approved by the order of the State Tourism Administration of Ukraine dated 16.03.2004 No. 19 and other regulatory and legal documents.


Offer (public offer)/ Subject of the contract.

2.1. The subject of the Public Offer/Agreement is the provision of services by the Hotel to the User for a fee accommodation, by providing a room (place) for temporary accommodation at the address of the location to the Hotel, in a specially equipped room (room) by the reservation order. In addition to accommodation services for temporary accommodation, the Hotel may provide additional services on a paid basis following the terms of this contract and the rates/prices specified in the information documentation of the Hotel and/or on the aquadar.com website.
2.2. The contract is considered concluded and becomes effective as an accession contract from the moment the service customer performs any action provided for in clause 3.4 of the contract, which means full and unconditional acceptance by the latter of all the terms of the contract without any exceptions and/or restrictions under Article 642 of the Civil Code of Ukraine. The contract for the provision of accommodation services is concluded by the User by accepting the Public Offer, has legal effect in accordance with Article 642 of the Civil Code of Ukraine and is equivalent to the contract signed by the parties, and it is considered that the User has read and agrees with the terms of this Public Offer (agreement).


3. Procedure for concluding a contract.

3.1. The contract is concluded between the Hotel and the User in the form of an accession contract (Article 634 of the Civil Code of Ukraine).
3.2. The acceptance (acceptance) of the Public Offer is the performance by the User of any of the actions specified in Clause 3.4 of the Agreement.
3.3. Acceptance (acceptance) of the Public Offer means full, unconditional, and unconditional acceptance by the User of all the terms of the contract without any exceptions and/or restrictions and is equated according to Part 2 of Art. 642 of the Civil Code of Ukraine until the Parties conclude a bilateral written contract on the terms set forth in this Public Offer.
The conclusion of the contract means that the User:
– has fully familiarized himself with and complies with the rules for staying at the Hotel;
– acknowledges the unconditional suitability of the Hotel premises to meet the needs described in this contract;
– accepts all terms of this contract without comments or objections.
3.4. In accordance with Article 642 of the Civil Code of Ukraine, the user confirms the acceptance of the Public Offer in case of any of the following actions:
– payment of temporary accommodation services through the reception and accommodation service (reception) in cash or by bank transfer on the basis of issued invoices, or by bank card;
– direct use by the User of Hotel services (accommodation);
– filling out the guest registration card at the reception.
3.5. The user undertakes to independently enter (notify) reliable personal data and information that correspond to reality when registering to receive services at the Hotel.
3.6. The term of acceptance of this Public Offer is unlimited.


4. Hotel services and accommodation conditions.

4.1. The hotel provides basic services that are included in the price of accommodation, and additional services that are provided for a separate fee.
4.2. The main services include the provision of a room for accommodation, room cleaning, meals (breakfast), emergency calls, “alarm clock” service at a specified time, use of an iron and ironing board, wireless Internet access, and other services provided for by the Hotel Rules.
4.3. Additional services include other services related to temporary accommodation, but not included in the price of accommodation, in particular, restaurant, mini-bar, conference service, holding banquets and wedding ceremonies, organization of excursions, animation for children and adults, SPA services (cosmetology, massage studio, wellness procedures), and other services that can be provided by the Hotel.
4.4. The day of registration is the date of the User’s arrival at the Hotel.
4.5. The day of departure is the date of the User’s departure from the Hotel.
4.6. Registration and check-in at the Hotel begins at 14:00 local time on the current day.
4.7. Check-out time on the day of departure is until 12:00 (local time) when the User/Users must vacate the room on the day of departure.
4.8. For morning check-in with the purpose of accommodation on the territory of the Hotel between 06:00 and 14:00 hours – an additional payment of 50% of the room price for 1 (one) billing day (breakfast is included) is charged, for check-in during from 00:00 to 06:00 – in the amount of 100% of the room price for 1 (one) billing day.
4.9. In case of staying at the Hotel for less than 1 (one) day, payment is charged in full
day regardless of the estimated time.
4.10. Check-out after 12:00 is an additional service and is provided depending on
availability of free numbers, unless otherwise specified in the Application.
4.11. In case of departure after the estimated time before 24:00, payment
per hour is 10% of the room price per day.
4.12. Accommodation of the User in the Hotel is carried out on a pre-paid basis, with
simultaneous presentation by the User to the reception employee of a passport or other document certifying his identity (passport of a citizen of Ukraine, passport of a citizen of Ukraine for traveling abroad, diplomatic or service passport, seafarer’s identity card, permanent residence permit, document for residence in Ukraine of a person, who lives in Ukraine, but is not its citizen, a national passport of a foreigner or a document that replaces it and a visa for the right to stay in Ukraine, a birth certificate of minor children who have not reached the age of 16, a driver’s license, for military personnel – an identity card or a military ticket, certificate issued at the User’s place of work, etc.), as well as filling out and leaving at the reception a guest registration card in a specified form for all Guests staying at the Hotel, including children. In the absence of the above-mentioned documents, the User recognizes the right of the reception staff to refuse the provision of temporary accommodation at the Hotel.
4.13. Accommodation of Guests with animals is possible only with prior agreement
by a representative of the Hotel, under the conditions stipulated by the Hotel Rules posted on the aquadar.com website. If the accommodation of Guests with an animal is agreed upon, the presence of the animal’s passport and a certificate from a veterinarian about the availability of vaccinations are mandatory.
4.13.1. The accommodation of animals in the Hotel is allowed in the number of no more than two in one numbers.
4.13.2. The cost of accommodation for each animal is 50% of the cost of 1 (one)
a day of single accommodation (regardless of the length of stay of the Guest).
4.14. The user after filling out the guest registration card receives a key/credit card for the room provided for accommodation from the Hotel reception staff.
4.15. For staying in a room with parents of children up to and including 5 years old, over
the set number of residents for the corresponding room category, without provision
additional places, the fee for temporary accommodation services is not charged.
4.16. Children up to 5 years old can be provided with a cot free of charge.
4.17. There is an additional charge for staying in the room of a child/children aged 5 and over
for each child for breakfast without providing an extra bed.
4.18. For placing a child/children aged 5 and over on an extra bed in the room
and for providing children under 5 years of age with an additional bed in the room – a fee is charged according to the price list of the Hotel.
4.19. At the end of the paid period of stay, the Guest must leave the room and free it from personal belongings and luggage no later than 12:00 (check out time) for the local time of the last paid day of departure or pay for an extension of the period temporary stay in the room in the absence of reservation of the specified room by third parties.


5. Cost, reservation and cancellation of services.

5.1. The cost of services is determined by the Hotel on the website aquadar.com. and/or in offers on social networks and/or at the reception desk and is paid by the User in national currency based on the invoice issued by the Hotel as a result of the reservation processing.
5.2. Services are provided on the terms stipulated in this contract and the Hotel Rules.
5.3. The price of temporary accommodation services includes services according to the selected order when booking. Additional services are paid by the User separately.
5.4. Ordering (booking) Hotel services are carried out by the User sending an order for booking Hotel services on the website aquadar.com., at the reception desk, in telephone mode, and/or via messenger (Telegram; Viber) indicating the period of stay, date and time of check-in and departure, number of seats and rooms, category of rooms, surname and initials of the User, etc. Users, number of children and their ages, extra beds, etc.
5.5. After receiving the order for the reservation of services, the Hotel sends to the User in messenger or by e-mail or issues at the reception desk an invoice for payment indicating the cost of the booked services and/or forms with the help of the software of the Hotel’s website the cost of the Hotel’s services to be paid by the User.
5.6. On the day the Hotel issues the invoice, the User must pay the amount of accommodation funds by non-cash transfer or in cash, or with the use of payment cards by using the payment system.
5.7. The user has the right to pay for the booked services through the Hotel’s website.
5.8. After the funds are credited to the Hotel’s current account, the latter provides the User with confirmation of the reservation.
5.9. Early registration of Users is possible only if it is provided for in the order and is subject to additional payment in accordance with the procedure provided for in this contract.
5.10. Early check-in and late check-out (check-out) an additional services that are paid by the terms and conditions of this contract and Hotel rules.
5.11. In case of eviction of the User before the scheduled departure date, the Hotel does not refund the reservation fee specified in the order.
5.12. If the User stayed at the Hotel for less than one (1) billing day, he pays the cost of his room/rooms for one (1) billing day.
5.13. Payment procedure when booking:
5.13.1. If services are booked more than 96 hours before arrival, payment is made within 72 hours.
5.13.2. If services are booked 48 to 96 hours before arrival, payment is made within 24 hours.
5.13.3. In case of reservation of services from 24 to 48 hours before check-in, payment is made within 12 hours.
5.13.4. If services are booked 24 hours before arrival, payment is made within 2 hours.
5.14. In case of violation of the terms provided for in Clause 5.13 of Section 5, the reservation is canceled.
5.15. In case of refusal of accommodation less than 7 days before the date of arrival, the amount of advance payment is not returned.
5.16. To confirm a reservation for a stay of 1-2 days, the Guest makes an advance payment in the amount of 100% of the cost of accommodation, in case of a reservation for more than 2 days, the Guest makes an advance payment for 2 nights within 3 calendar days.
5.17. If additional services were provided to the Guest during the stay, the Guest will be billed for such services on the day of departure.
5.18. Cancellation terms and penalties, namely for canceling an order/part of an order:
•  If you cancel your reservation more than 7 days before arrival at the hotel, cancellation is free.
• In case of cancellation of the reservation less than 7 days before arrival at the hotel or in case you do not check into the hotel – a fine of 100% of the cost of living.
• In case of cancellation of the order balance during the stay (check out before the scheduled date) – you pay a fine to the Management Company in the amount of 100% of the cost of 1 (one) settlement day.

5.19. In the event of any force majeure circumstances, including but not limited to
exclusively in case of escalation of any military actions on the territory of Cherkasy region or neighboring regions, which may affect the possibility of providing services by the Hotel, at the time of the User’s stay/being on the territory of the Hotel or before the day of the User’s registration or at any time after the day of the User’s registration – the price for the provision of services by the Hotel, which was paid by the User, is not subject to reimbursement by the Hotel.
5.20. When ordering services by the User at regular and/or promotional rates, including in the event of any force majeure circumstances, the date of registration may be changed upon agreement between the User and the Hotel under the terms of this contract. At the same time, changing the date of the registration day to a new date can be carried out exclusively at the current tariff for the latest date of the registration day no later than 6 months from the date of the paid reservation.
5.21. Changing the date of registration and cancellation of booked services is carried out by the User by contacting the reception desk, by phone, and/or via messenger (Telegram; Viber), but only if there is a mandatory confirmation of the change of the date of registration and cancellation of booked services by a Hotel employee.
5.22. If the User violates the payment procedure and conditions established by this contract, the Hotel has the right to reimbursement of the payment arrears and may terminate the provision of services until the debt is paid.
5.23. The prices and terms of payment specified in this contract are contractual and confidential.
5.24. The hotel has the right to refuse to accept an order (booking) of services in the following cases:
5.24.1. No available rooms and/or other hotel services.
5.24.2. Existence of indebtedness of the User to the Hotel for previously provided services.
5.25. In the case of payment of services by the User directly at the place of provision of services on the day of registration, such a condition must be specified in the agreed order of the User.


6. Payment procedure

6.1. Hotel services, including additional ones, are provided to the User on a paid basis in accordance with the terms of the contract and tariffs/prices indicated on the Hotel website and/or at the reception desk, menus, price tags, prices, other information documentation of the Hotel, taking into account the selected room category. Tariffs/prices for the Hotel’s services and their list are determined and changed exclusively by the sole decision of the Hotel.
6.2. The right to receive/use the Hotel Services is usually granted after payment for the relevant services, in accordance with the tariffs/prices. The hotel has the right to provide services to the User without prepayment.
6.3. In the event that the Hotel provides services without prior payment (except for accommodation services), the User is obliged to pay for such services on the day of departure according to the issued invoice in accordance with the prices indicated in the information documentation of the Hotel and/or on the website of the Hotel. In this case, the User pays for the services provided (fulfills the terms of the Agreement) at the location of the Hotel.
6.4. The hotel has the right to apply a system of discounts for temporary accommodation services.
6.5. In case of non-receipt of the corresponding payment within the terms specified in the Agreement, the Guest’s order is considered non-guaranteed. In case of a non-guaranteed order, the Hotel reserves the right to cancel this order unilaterally and does not bear any responsibility, including property, for this to the Guest. If the Guest provides documents confirming the withdrawal of funds from the Guest’s current account in favor of the Hotel before the date of arrival, such an order is considered guaranteed.
6.6. Payment for Hotel services can be made in the national currency of Ukraine – hryvnias, by non-cash settlement, including by Visa, Maestro, MasterCard payment cards, through a payment terminal, the online payment system in the reservation module on the website, and in cash by depositing funds in hotel cash desk.


7. Rules for using Hotel property.

7.1. The hotel provides users with furnished rooms equipped with household appliances, sanitary ware and other equipment. Hotel rooms and common areas are insulated, have modern decoration, engineering networks, equipment, equipment that meet all requirements at the time of commissioning.
7.2. Users must treat the property of the Hotel with care, use the equipment as intended, and comply with fire safety requirements. In case of detection of damage to property, technical malfunctions, emergency events (flooding, fire, broken glass, etc.), it is necessary to immediately notify the reception staff.
7.3. After checking into the room, within one hour, the User has the right to inform the reception staff about the detected defects in the decoration and equipment of the Hotel room. In the absence of a statement and when the reception employee discovers the loss or damage to the property of the Hotel on the day of the User’s departure, the User shall pay for material damages.
7.4. Upon check-in, the User is given a key or a plastic card, which he must return on the day of departure. If the User loses the key or plastic card, a fine of UAH 150 will be charged.
7.5. In the event of loss or damage due to the User’s fault to property (including towels, bathrobes, dishes, furniture, various equipment, etc.) located on the territory of the Hotel, the User is obliged within 3 (three) calendar days, but no later than leaving the Hotel to compensate for the damage, the amount of which is determined: in accordance with the prices specified in the information documentation of the Hotel and/or on the Hotel website, and in the absence of such prices – by a commission consisting of: a reception employee and any other employee of the Hotel under the conditions of transparency and the market value of lost or damaged property.


8. Rights and obligations of Users of accommodation services at the Hotel.

8.1. Users of accommodation services have the right to:
– use accommodation services and additional services in the order specified in the contract and other documents of the Hotel;
– to receive additional services that were not pre-ordered on a general basis with payment of such services on the spot according to the current price lists of the Hotel, if it is possible to provide such services.
– to receive complete and reliable information about the hours of access to the Hotel territory, the cost of services provided in the Hotel territory;
– contact the reception staff regarding the quality of the temporary accommodation service, leave complaints, reviews and suggestions.
– reduce the number of Guests and/or cancel the order in advance(Conditions according to Clause 5.18 of the Agreement apply).
8.2. Users of accommodation services are obliged to:
– unconditionally comply with the terms of the contract and Hotel Rules;
– respect the rights of other Hotel users;
– observe moral and ethical standards, refrain from using
obscene expressions in public areas of the Hotel;
– comply with the rules for staying at the Hotel, the rules for using the Hotel’s infrastructure facilities, the regulations for access to them, which can be found at the reception;
– to ensure careful treatment of the premises, property, equipment and inventory received from the Hotel in accordance with this contract and the Rules of the Hotel, and to compensate for the damage caused.
– in the case of loss or damage due to the User’s fault to property (including towels, bedding, dishes, furniture, various equipment, etc.) located on the territory of the Hotel, the User is obliged to leave the hotel within 3 calendar days, but no later than The hotel shall compensate the damage in accordance with the procedure specified in the contract.
– to observe the rules of fire safety and rational (economical) use of electrical appliances and Hotel equipment.


9. Rights and obligations of the Hotel.

The hotel is obliged to:
– provide paid services to the User in a timely, high-quality and complete manner;
– provide the Guest with full information about the terms of service provision: terms of reception, accommodation, holding of the event, provision of food, cost of service, form and procedure of payment, prices for additional service;
– timely inform the Customer about changes in prices for services.
– not to revise the prices for services according to the agreed order, provided they are paid in full and on time.
– during the entire period of service provision, ensure the premises that will be used for the purpose of providing services, depending on their functional purpose, with uninterrupted water supply, electricity, uninterrupted operation of sewage, ventilation and lighting.
– to ensure the operation of the medical center and the provision of first aid.
– to ensure full compliance of the services provided with sanitary-epidemiological norms and rules;
– provide access to telephones for use in extreme cases.
– if necessary, provide free storage of the Guests’ luggage in the storage room before and after vacating the rooms on the day of the Guests’ check-in/check-out from the Hotel.
– to respond in a timely manner to the requests of Users related to the provision of temporary accommodation services, taking measures to eliminate breakdowns and accidents in the Hotel rooms in the shortest possible time (in case of impossibility to eliminate an accident or breakdown in the room, another number of the category no lower than the one that was provided is provided agreed on the day of arrival). In the case of providing a room of a lower category, the Hotel returns to the User the difference between the prices of the rooms, and in the case when the Hotel does not have the possibility to relocate the User to another room, the latter is refunded the remaining amount of the cost paid by the User for staying in the room.
– be responsible for the completeness and serviceability of the equipment in the rooms, as well as for the quality of the room’s preparation for check-in;
The Hotel is not responsible for money, things and any other material values ​​that were left in the room, lost on the territory of the Hotel, or lost for any reason. Also, taking into account that the Hotel is located on the territory where water procedures services are provided, the Hotel is not responsible for injuries received by Users as a result of using water procedures.
9.2. The hotel has the right to:
– refuse to provide services that have not been paid or paid late in the event of the absence of an actual opportunity to provide such services or the absence of free rooms for temporary accommodation.
– enter the Hotel room for cleaning, changing linen, except for cases when the User has hung a sign with the inscription “Do not disturb” on the door handle from the outside;
– upon prior agreement with the User, enter the Hotel’s room to check water supply systems, air conditioning or eliminate deficiencies in their functioning;
– has the right to revise the prices for services without notifying the Customer, except for those agreed upon in the order;
– in the event of the end (coincidence) of the agreed and 100% paid period of the User’s stay at the Hotel and/or the User’s absence from the place of temporary residence for more than 2 hours without payment, independently vacate the room from the User’s personal belongings, at the same time compiling a description of the property left behind User;
– in case of more than two violations of public order by the User, invite employees of internal affairs bodies to clarify the circumstances and establish the facts of such violations;
– prematurely, without refunding the funds paid by the User for temporary accommodation, terminate the contract for the provision of temporary accommodation services, with simultaneous forced eviction from the Hotel territory in the event of:
– being in a state of strong alcoholic and/or narcotic and/or toxic intoxication or under the influence of psychotropic substances;
– smoking in the rooms, as well as on the territory of the Hotel, except for specially designated places;
– storing or bringing weapons, explosives, flammable, caustic, poisonous, narcotics and other dangerous objects and substances without the consent of the Hotel and without proper permits;
– violation of the rules of public order;
– violation of the rules of accommodation in the Hotel;
– violation of contract provisions;
– systematic complaints of other Hotel Users about violations of their rights, freedoms and peace of mind.

10. Requirements and prohibitions on the territory of the Hotel.

10.1. The following is prohibited on the territory of the Hotel:
– leave outsiders in the room (persons who did not fill out the guest registration card);
– hand over the number keys to third parties;
– keep bulky things and objects in the room, except for suitcases (boxes, boxes larger than 100 x 100 x 100 cm, bicycles, scooters, mopeds, etc.);
– store substances, materials and objects dangerous to human life in the room;
– consume alcoholic beverages, with the exception of those paid at the cork fee rate.
– move furniture and interior items;
– take dishes, cutlery, food and drinks out of the restaurant;
– use the property, equipment of the Hotel and rooms for other purposes;
– bring your own things into the Hotel territory with your hands. Entry of the Guest’s vehicle onto the territory of the Hotel is categorically prohibited;
– smoking in rooms and other places not designated for smoking. A fine of 50% of the daily room rate is imposed for smoking in the Hotel premises. In case of repeated smoking in prohibited places, the Hotel administration has the right to evict the User unilaterally.
– disturb the peace of other Hotel Users after 10:00 p.m. until 8:00 a.m., creating commotion or noise;
– to store or bring weapons, explosive and flammable, caustic, poisonous, narcotic substances and other dangerous objects. Users who have the right to carry and store weapons are obliged to notify the reception on the day of arrival, presenting the relevant permit documents;
– knowingly pollute the Hotel territory with cigarette butts, garbage, etc.;
– throw any objects and things from balconies or windows;
– use your own irons, electric heating devices, kettles, kettles, etc., which are not included in the room.
– during wartime, there are temporary restrictions on visiting the forestry territory, walking into the forest is prohibited;
– it is strictly forbidden to light a bonfire on the territory of the Hotel.
10.2. In case of violation by the User of the rules of conduct and/or obligations specified in the relevant sections of the contract and the Hotel Rules, the reception has the right to deny the User the further provision of temporary accommodation services, and thus stay on the territory of the Hotel, with the obligatory drawing up of the relevant act and , if necessary, with the involvement of law enforcement officers.


11. Force majeure.

11.1. In the event of force majeure circumstances: war, introduction of martial law in Ukraine, flood, earthquake, fire, strike, epidemic, changes in legislation, etc., the parties shall not be liable for failure to fulfill any provision of this Agreement, if such failure is a consequence of force majeure circumstances).
11.2. The Party for which it has become impossible to fulfill its obligations as a result of force majeure circumstances, is obliged to notify the other Party in writing of the time of occurrence and termination of such circumstances.
11.3. The effect of force majeure circumstances must be confirmed by a certificate (official document) issued by the Chamber of Commerce and Industry of Ukraine in Kyiv or regional Chambers of Commerce and Industry authorized by it. The obligation to obtain such a document is imposed on the Party, the fulfillment of whose obligations the force majeure circumstances directly affected.
11.4. The Parties understand and agree that this Agreement is concluded by the Parties during the period of force majeure (circumstances beyond their control), namely the military aggression of the Russian Federation against Ukraine, which became the basis for the introduction of martial law in accordance with the Decree of the President of Ukraine dated February 24, 2022 No. 64/2022 “On the introduction of martial law in Ukraine” with continuation in accordance with the legislation of Ukraine.
11.5. The Parties to the Agreement may refer to such circumstances as force majeure only if such circumstances actually exist. That is, if controversial situations arise for one of the Parties, such Party will have to prove that it was precisely in the presence of force majeure that it was unable to fulfill its contractual obligations and it did not have an objective opportunity to fulfill them.


12. Responsibility of Users and the Hotel.

12.1. The parties are responsible to each other for the damages caused due to the violation of the conditions defined by the contract.
12.2. The hotel must take measures to eliminate the shortcomings of the provided service within the time limits specified by the technical characteristics and the terms of restoration of the breakdown or service.
12.3. In case of untimely payment of the provided additional services in the manner and under the conditions stipulated in clause 5.17. of Section 5 of the contract, the Guest shall pay the Hotel a penalty in the amount of 3% of the amount of additional services provided for each day of late payment.
12.4. The payment of the fines provided for in this contract shall be made by the Guest to the current bank account of the Contractor within 3 (three) banking days from the moment of the corresponding violation and (or) the occurrence of the corresponding event, which are the basis for the application of fines, as well as after receiving of the corresponding bill from the Hotel.
12.5. In case of non-payment or refusal of the Guest to pay the fines provided for in this contract, the Hotel reserves the right to refuse the Guest further orders until the said fines are paid in full.
12.6. In the case of providing accommodation services, at the request of the Guest and the actual availability of the Hotel, it is possible to change the room category to a higher one. At the same time, the difference in cost is paid by the Guest, based on the current price for this room category.
12.7. The hotel is not responsible for deficiencies in the services provided, if it proves that they were caused by the fault of the User himself or as a result of force majeure.
12.8. The user bears full responsibility for damage to the property of the Hotel. In this case, in addition to compensation for damages, the User must voluntarily or in a court of law compensate the Hotel for the costs associated with the downtime of the room during repairs, replacement of furniture, etc. cases


13. Payment card details transfer security policy.

13.1. When paying for an order by bank card, payment processing (including entering the card number) takes place on a secure page of the processing system. This means that the User’s confidential data (card details, registration data, etc.), their processing is fully protected. Third parties cannot obtain the User’s personal and bank data.
13.2. When working with card data, the information protection standard is applied,
developed by the international payment systems Visa and MasterCard – Payment Card Industry Data Security Standard (PCI DSS), which ensures safe processing of details of the Owner’s Bank card. The applied data transmission technology guarantees the security of transactions with bank cards through the use of Secure Sockets Layer (SSL) protocols.


14. Personal data.

14.1. The user gives his consent to carry out, without restrictions, any actions regarding the processing of his personal data for the purpose of the Hotel, fulfilling the terms of the concluded contract on the provision of hotel services, implementing and protecting the rights of the parties under the concluded contract on the provision of hotel services, performing other powers, functions, obligations ties that do not contradict the legislation of Ukraine and the terms of the concluded contract.


15. Video surveillance.

15.1. The territory of the Hotel, all entrances to it, internal stairs and corridors are monitored by video cameras. All information is recorded, recorded on digital media and stored. Video surveillance is carried out for the safety of Users, their property, and the property of the Hotel. By accepting this Public Offer (agreement), the User takes into account and does not object to the fact of using video surveillance systems in the Hotel premises (with the exception of rooms and toilet cubicles).


15. 16. Entry and parking of motor vehicles.

16.1. Parking of vehicles on the territory of the Hotel is not provided.
16.2. It is strictly forbidden to enter the territory of the Hotel, to leave vehicles
facilities at the entrances and exits of the road near the Hotel.
16.3. The hotel is not responsible for the safekeeping of the User’s vehicles (or property in the vehicle).


17. Other conditions.

17.1. The relations of the Parties, not regulated by this contract, are governed by the norms of the current legislation of Ukraine.
17.2. The contract is valid until the Parties fully fulfill their obligations.
17.3. The invalidity of individual provisions of this agreement does not entail the invalidity of the Agreement as a whole.
17.4. In the event of disputes under this contract, the Parties will take all measures to resolve them through negotiations.
17.5. In case of impossibility of resolving disputed issues through negotiations, disputes between the Parties shall be resolved in court in accordance with the current legislation of Ukraine.
